This website is operated by By Inova. Throughout the website, the terms “we,” “us,” and “our” refer to By Inova.

By visiting our website, purchasing a product, booking a service, or otherwise using our website, you agree to these Terms of Service and all policies referenced herein, including our Return and Refund Policy, Shipping Policy, and Privacy Policy.

If you do not agree to these terms, please do not use our website or purchase our products or services.

  1. ELIGIBILITY

By using this website, you confirm that you are at least the age of majority in your state or country of residence or that you have permission from a parent or legal guardian.

You may not use our products, services, website, designs, or content for any unlawful or unauthorized purpose.

  1. PRODUCTS AND SERVICES

By Inova offers personalized products, digital illustrations, stationery, event products, and live personalization services.

We make every reasonable effort to display product descriptions, photographs, dimensions, materials, and colors accurately. However, colors may vary depending on the customer’s screen, printer, materials, lighting, or production process.

Because many products are handmade or personalized, minor variations in lettering, spacing, placement, color, texture, and decorative details are expected. These variations are part of the handmade process and are not considered defects.

We reserve the right to modify or discontinue any product or service without notice.

  1. PERSONALIZED ORDERS

Customers are responsible for carefully reviewing all personalization information before submitting an order, including:

• Names and spelling
• Dates and wording
• Colors and design selections
• Quantities and dimensions
• Uploaded photographs or artwork
• Shipping and contact information

By Inova is not responsible for errors contained in information submitted or approved by the customer.

Once an order is placed or production begins, changes cannot be guaranteed. If a requested change can be accommodated, an additional fee and extended production time may apply.

We reserve the right to reject personalization containing unlawful, discriminatory, threatening, hateful, defamatory, infringing, or otherwise inappropriate content.

  1. CUSTOM DESIGNS AND APPROVALS

When a proof or preview is provided, the customer is responsible for reviewing and approving all details before production.

Approval authorizes By Inova to proceed with the design as presented. Changes requested after approval may require an additional fee and may delay completion.

Unless otherwise stated in writing, the purchase of a personalized product does not transfer ownership of the original design, artwork, production files, templates, concepts, or intellectual property created by By Inova.

  1. DIGITAL ILLUSTRATIONS AND DIGITAL PRODUCTS

Digital products do not include physical delivery unless expressly stated in the product description.

Customers receive a limited, non-exclusive, non-transferable license to use the delivered file for personal purposes unless commercial usage rights are purchased or granted in writing.

Customers may not resell, reproduce for resale, distribute, sublicense, modify for commercial use, claim authorship of, or use By Inova artwork or digital products to create competing products without written authorization.

Turnaround times are estimates and begin only after we receive all required information, photographs, instructions, and payment.

  1. LIVE PERSONALIZATION SERVICES

Live personalization services are subject to availability and may require a separate proposal, service agreement, and non-refundable retainer.

An inquiry does not reserve an event date. A date is secured only after the required agreement is signed and the applicable retainer is received.

Final pricing may depend on the event date, location, duration, number of guests or items, complexity, materials, travel requirements, parking, accommodation, and additional personnel.

The client is responsible for ensuring venue access, obtaining required permissions, providing accurate event information, and complying with the workspace requirements included in the proposal.

If a separate service agreement conflicts with these Terms of Service, the signed service agreement will control matters specific to that event.

  1. PRICES AND PAYMENTS

All prices are displayed in the currency indicated on the website and may change without notice.

Applicable shipping charges, taxes, duties, and other fees will be shown at checkout or included in a custom proposal when applicable.

You agree to provide current, complete, and accurate billing and payment information. We may cancel or refuse an order if payment cannot be verified, fraud is suspected, pricing information is incorrect, or the order cannot be fulfilled.

  1. ORDER ACCEPTANCE

Submitting an order does not guarantee acceptance. We reserve the right to refuse, limit, or cancel an order for reasons including suspected fraud, product unavailability, pricing errors, technical errors, inappropriate customization requests, or inability to complete the requested work.

If we cancel an order before production begins, any eligible payment will be returned to the original payment method, except for non-refundable retainers or completed work as permitted by law and the applicable agreement.

  1. RETURNS, EXCHANGES, AND REFUNDS

Because our products and services are personalized or created specifically for each customer, all sales are final to the fullest extent permitted by law.

We do not accept returns, exchanges, cancellations, or refunds except when required by law or expressly stated in our Return and Refund Policy.

Nothing in this policy limits any non-waivable consumer rights available under applicable law.

  1. SHIPPING AND DELIVERY

Physical orders are processed and shipped according to our Shipping Policy. Processing and delivery estimates are not the same.

Customers are responsible for entering a complete and accurate delivery address. By Inova is not responsible for delays or losses caused by incorrect customer information, carrier disruptions, weather, customs processing, or circumstances outside our reasonable control.

If we cannot ship within the stated timeframe, we will provide notice and the options required under applicable law.

  1. INTELLECTUAL PROPERTY

All website content—including the By Inova name, branding, logos, illustrations, designs, photographs, graphics, product descriptions, templates, videos, and written materials—is owned by or licensed to By Inova and is protected by applicable intellectual-property laws.

Content may not be copied, reproduced, republished, distributed, sold, modified, or used commercially without prior written permission.

  1. CUSTOMER-PROVIDED CONTENT

By submitting photographs, names, logos, artwork, wording, or other materials, you confirm that you own them or have permission to authorize their use.

You grant By Inova the limited right to use those materials solely to create and fulfill your order or service.

You are responsible for claims arising from materials you submit without the necessary ownership or permission.

  1. OPTIONAL MARKETING USE

By Inova will not use identifiable customer photographs, private event details, or customer-provided artwork for marketing without permission when consent is legally required.

Permission to share completed work may be addressed during checkout, through a separate consent request, or in an applicable service agreement.

  1. THIRD-PARTY SERVICES

Our store may be hosted by Shopify and may use third-party payment providers, shipping carriers, applications, or service providers.

Your use of third-party services may also be governed by their respective terms and privacy practices. By Inova is not responsible for third-party websites or services outside our control.

  1. PROHIBITED USES

You may not:

• Use the website for unlawful or fraudulent purposes
• Infringe intellectual-property or privacy rights
• Submit malicious code or interfere with website security
• Collect customer or website data without authorization
• Misrepresent your identity or payment information
• Reproduce or resell our designs without permission
• Use our products or content to create deceptive, harmful, or unlawful materials

We may suspend or terminate access for violations of these terms.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, products, services, and website content are provided “as is” and “as available,” except for any express commitments stated in a product description or signed agreement.

We do not guarantee that the website will always be uninterrupted, secure, or error-free.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, By Inova will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, products, or services.

Our total liability for a claim will not exceed the amount paid for the product or service giving rise to that claim.

Some jurisdictions do not allow certain limitations of liability, so these limitations apply only to the extent permitted by law.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless By Inova from claims, damages, or expenses arising from your violation of these terms, misuse of our products or services, or unauthorized materials submitted for personalization.

  1. SEVERABILITY

If any provision of these Terms of Service is found to be unlawful or unenforceable, the remaining provisions will remain in effect.

  1. GOVERNING LAW

These Terms of Service are governed by the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict-of-law principles.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service periodically. Changes become effective when the revised policy is posted on this website. The “Last updated” date will identify the most recent revision.
